My name is Abhay Patel. My previous employer deposited an amount into my salary account. When I inquired about this amount, they informed me that it was my full and final settlement. However, despite requesting a copy of the full and final statement, they have not responded to my emails.

Please advise on what steps I should take to obtain a copy of my full and final statement.

Send them a letter through registered post with an acknowledgment demanding the F&F document within 14 days of receiving this letter to avoid further proceedings. They will send it. If they don't send it, raise an industrial dispute at your regional labor office.

In which company are you currently working? No company wants to release final dues payment to be deposited in Bank A/c without completing exit formalities, such as clearance of debt, without your signature on final dues, Issuing relieving letter, and Experience Letter.

Hi Sirs,

I had worked in a construction company for the last 8 years and 5 months (from 2006 to 2014). For the first 7 years and 9 months, I was in the office, and for the last 8 months, I was on the site. Last year, I lost my husband to a sudden cardiac arrest. After his passing, I was transferred to work as a site engineer. Despite lacking prior experience in that field, I faced numerous challenges but could not bring myself to resign from my job. Ours was a love marriage, and following my husband's death, I had no one to support me. Consequently, I endured all the hardships at the site, working during the day and sometimes late into the night.

In December, I personally discussed with my boss, expressing my inability to continue at the site. However, he did not approve my request as the project was in its final stages. I am considering leaving after its completion. In January, the building became operational; it belonged to my boss who then assigned me as a maintenance engineer there. Unfortunately, the staff at the building were unpleasant and made things difficult for me over trivial matters. After a prolonged period of exhausting work, I have become physically weak and started experiencing health problems.

Subsequently, I emailed my resignation with a 25-day notice period. My boss requested me to complete the month first before further discussion, to which I complied. Although I finished the month as requested, during the last week, I fell ill with the initial stage of an umbilical hernia. Despite taking painkillers to manage the pain, I persisted and completed the month. On the final day, when I tried to discuss my illness with him, my boss refused to meet or speak with me. The following day, upon consulting a surgeon, I was advised medication, and with divine grace, was informed that I would recover with treatment. When I tried to inform my boss about this, he did not answer my calls and withheld my last month's salary.

According to my signed agreement, the notice period is 60 days. I possess all the necessary medical documentation and am currently resting. Am I entitled to that salary? What steps should I take to claim it and am I eligible for any additional benefits?

Do recheck with the HR. It could be that the courier/email regarding F & F settlement has not reached. The details are generally sent to the postal address/email ID provided on the Clearance Form filled on the LWD.

Do recheck your contact info with the HR. It could be that the courier has not reached you. Trust in HR. No professional HR can intentionally do such things.
