Dear Cite HR members,

Can anybody tell me if a strike can be conducted under any law? A strike itself is an act. One of my seniors asked me whether if a worker is going on strike, it should be under various acts. Please guide me.

Hi,

Strikes are normally conducted by trade unions or a union on unresolved issues between workers and management on various subjects related to the work environment or for collective bargaining. It is to show the strength of unions and is used as a last resort.

Any unresolved dispute that arises between a worker and an employer may lead to a strike. This can be a pen-down or tool-down strike, slogans or black badges within the premises, a wildcat strike, work-to-rule, or stopping work outside the gate or persuading workers not to go to work.

Any act done by a union, either directly or indirectly affecting the day-to-day activities of the business or productivity, can be termed as a strike.

I suggest young HR professionals should be familiar with relevant acts before asking questions as it will help clarify doubts. I do not intend to offend anyone, but I have observed that many in our field are now seeking spoon-feeding, which is not conducive to the profession.
