Dear All,

This is common nowadays. The person who resigned for PF withdrawal can continue working with the organization without any record. Pay him in cash until the time he gets re-appointed, but don't include him in the wages.

I could not understand how a HR personnel guide the employee to withdraw PF, while they require the employee to serve them also. At most, the employee will get 1 month's salary against 1 year of PF withdrawal. Can't the HR convince the management instead, and help the employee in getting a salary advance or staff loan instead of advising the employee to withdraw PF?

If the HR helps/guides employees the right way, it will be beneficial to the employer too. The productivity of the employee will be higher if they receive a little help with their personal life.

Dear all,

Can you please share the PF Act or rules section or paragraph that indicates the same situation? Where is it mentioned?

My question is, X employee resigned, and we cleared all his dues on the same day. After 15 days, we realized that he is our assistant and we decided to rejoin. Now, what happens in this case? Can we issue a new PF number? Can we consider him in the old number?

Request to all of you, please share the sections or paragraph in the PF Act or rules regarding the same case. Also, share the paragraph where it is written that a 60-day waiting period is required for transferring or withdrawing the PF amount.

Dear Ajay,

If an employee rejoins the same organization after 15 days of resigning, then in this case, a new PF number cannot be allotted to such an employee. The old PF account of that employee will be used for the purpose of PF contribution submission.

Secondly, for transferring the old PF fund to a new PF account, one need not wait for a 60-day period. It can be transferred at any time after joining somewhere else. The interest in such cases will be accumulated for up to 3 years of non-active status.

Thirdly, the declaration clause for non-employment is as follows:

"In the case of submission of an application for settlement under clause (s) of sub-paragraph (i) and in clause (b) of sub-paragraph (2) of paragraph 69 of the EPF Scheme, 1952, the claim should be submitted after two months from the date of leaving service provided the member continues to remain unemployed in an establishment to which the Act applies." Hi Guys,

Need urgent help! I was employed with company A for 1.5 years, and I did not withdraw/transfer my EPF amount. Then I worked with company B for one year. This time, I withdrew my EPF. Later, I joined back in company A (currently working here), and now they have opened a new EPF account for me. So now, I have 2 EPF accounts with the same company.

Is there a way that I can withdraw my previous EPF? Or can I transfer funds from my old EPF to the new one?
