Hi All, Please tell me if an employee joins on a Tuesday, is there any rule that the salary for the immediate Sunday will be deducted if he/she has not completed the 6-day-a-week cycle? I joined on 10th Sept 2013, and my accountant has deducted my salary for 15th Sept 13, saying it is a rule that the new joiner has to work for 6 days (only for the first week), or else he/she is not eligible to get paid for the first Sunday. Please tell me if this is justifiable.

If they deducted your salary for Sunday, stating you should have worked 6 days to earn a paid holiday, they're wrong. This might be a small and private firm. Many firms tweak the rules and regulations and cite it's their policy to do so. Since many people do not question or argue, they seem to have an advantage. Ideally, the payment is to be given for every day worked, and all paid holidays/weekly offs are a part of it. So even if you join on a Saturday, you should be paid for the next day's weekly off on Sunday just like others in your firm. Seniors' insights awaited.

Salary Deduction for New Employees
Well, the employee's salary gets calculated from the day of joining, and there's no way to deduct the salary for the particular reason specified. I would say that no registered or professional company will do this. It must be some low-level type of company that customized the policy for their benefit only.

Please review your offer of appointment. Are you being paid for the days worked, or are you paid monthly? In the case of daily wages, the accountant is correct in deducting the salary. However, for any monthly salaried personnel, the payment for Sunday is included unless you were absent on Saturday and Monday. Please check and let us all know.

You are eligible for Sunday because as soon as you join on Saturday, the relationship between employer and employee is established. Now, think of it another way: if Saturday or any other day is your last working day, you will not be eligible for Sunday or the next day's payment as the relationship is terminated.

Not justified ethically and morally. Legally also questionable. Thus unjustified albeit their own convenient rules! Please take up politely with Management for just and fair treatment.

Factories Act and Paid Holidays
See the sections related to the Factories Act. The first day of the week should be designated as a holiday for everybody as a paid holiday. Here, there is no question of completing 240 days or working 6 days a week, etc.
