Dear All,

Our company is paying PF contributions to those whose basic is less than or equal to Rs 6500. From next month onwards, we will be including all previously excluded employees. How should we proceed with this change? If we do not make these payments, they might assume we are defaulting on the payment.

Please advise.

Merely because their wages go beyond Rs. 6,500 from next month onwards, they will not become excluded employees. They will continue to be members of the P.F., and the employer and employee contributions will, however, be restricted to Rs. 6,500. So you will have no respite from filing P.F. challans/returns.

Thank you for your reply. I want to provide some more information. Currently, we are paying PF to two employees whose basic is less than Rs. 6,500. They are on the notice period. Once they leave, we won't have anyone whose basic is less than or equal to Rs. 6,500. Please guide us on how to proceed.

If all employees now covered under PF are left the Co then if the remaining employees are excluded employees ,you need not deduct or pay contribution in respect of them. VARGHESE MATHEW 9961266966

Once the two employees who are members of the P.F. Scheme leave and the remaining are excluded employees from the date of their joining your company, you need not pay any P.F. contribution in respect of those employees. However, the company shall take the following steps:

1) It shall collect their declaration forms in Form 11 and keep it on record.
2) It shall send NIL statement in Form-5, which is a monthly return since there is no employee qualifying for the P.F. scheme.
3) It shall file a return in Form 10 every month denoting the details of employees who are leaving service.

There is no mandatory requirement to deduct the PF, but if you wish, you can contribute by deducting the same as per the norms of PF. The amount of PF will be distributed to EPF on Rs 6500/-; the difference amount will be transferred to FPF.

Dear friends,

I have joined a new company, and I am facing difficulties there, specifically legal issues.

1) The previous HR has absconded without handing over any legal documents such as annual returns or IF documents.

2) Additionally, he has retained all the PF withdrawal forms, some of which are dated back to 2005 for resigned applicants and 2007 for others. I have gathered around 130 withdrawal applications that have not been forwarded to the PF office.

3) The absconded HR mentioned filing annual returns for 2011-2012, but there are no hard or soft copies available. Upon inquiry at the PF office, particularly in the EDP department, I received a negative response.

4) The situation is dire, especially for female workers who resigned in 2011 and 2012. I am unable to process their PF forms due to missing Form 3A for 2011-2012. These individuals urgently require their PF money as their standard of living is below the poverty line.

I am feeling extremely frustrated. What steps should I take to obtain the returns for 2011-2012? Also, could you please advise on the deadline for filing the 2012-2013 returns?

I would greatly appreciate any guidance you can offer.
