Pls suggest whether we have to take approval for Holiday List from Labour Office? If yes what is the procedure.

Create Holiday list and send it to the Labour office with a cover letter by speed post or by registry and keep the record with speed post reciept. Thanks Dinesh

Dear Mangesh ji, There is no provision in law for taking approval from labour office for holiday list. However, you need to take permission for working 24x7.

Approval of leave is mandatory as per various state enactments of National and Festival holidays. It is also to be ensured that festival holidays coming on Sundays shall be substituted by another festival holiday.

In Tamil Nadu, one has to get the approval of the concerned Assistant Inspector of Labour by filing Form I & II of the National and Festival Holidays Act and having it approved by him in Form III. Apart from the 4 National Holidays, namely Jan 26th, May Day, Aug 15th, and 2nd Oct, 5 festival holidays need to be indicated with the consent of the majority of employees. The approved Form III should be exhibited in the organization. If any changes are required, necessary amendments should be sent and approved by him. In total, 9 holidays have to be declared in a year. Every year, in the last week of December, you have to submit the list of holidays in Form V to the Labour Inspector.

The rule of substituting a festival holiday falling on Sunday with another festival holiday can be applied to employees who take their weekly off on days other than Sunday. Kindly suggest.

We have to send the declared national and festival holidays totaling to nine compulsorily in Form V under the T.N. National Festival Holidays Act of 1958 before 31st December to the Local Inspector of Factories in triplicate.

For a new company, the application should be made in Form I, and the same will be approved by the Inspector of Factories in Form II, which should be retained. Whenever inspection is carried out, this form should be produced on demand.

Yes, Singh, it is applicable to establishments which run on a 24x7 basis as well. This is because Sunday is treated as a public holiday by the common notification issued by the government, and the official notification of the government governing the holidays for the year will always show Sundays as closed holidays.
