Dear Seniors, Please confirm the solution to some of my queries.

Leave Calculation Query

1. One of our employees took leave from 3rd Nov 2012 to 12th Nov 2012. Our factory will be closed from 13th Nov 2012 to 15th Nov 2012 on the occasion of Diwali. He is scheduled to join us on 16th Nov 2012. Should his leave be counted until 15th Nov 2012 or 12th Nov 2012?

The holidays from 13th Nov to 15th Nov cannot be treated as leave (whether PL, CL, or LOP/LWP). They can be considered as leaves only when the prefix and suffix of the leave period are working days, and such closed holidays/weekly offs fall in between. In this case, the employee had joined immediately the day next to the holiday period, i.e., 16th November, and hence the leaves can be considered only up till 12th November.

Also, please visit this link for a better understanding. The case is related to sandwich leaves, but the meaning can be considered here too: https://www.citehr.com/437502-confus...ve-policy.html

Leave Calculation During Holidays

The leave will be calculated until 12th November only, since from 13th to 15th November, the factory was closed and declared a holiday on account of Diwali. Therefore, we cannot club leave and holidays. If your factory was not closed during the Diwali holidays, then the employee would have joined on 13th November itself. Otherwise, you should consider LOP/PL/CL/SL as the case may be.
