In an establishment under the T N Shops and Establishment Act, the working hours are prescribed as 48 hours in a week, after which an employee can be given a week off of one day. In these circumstances, if an establishment wishes to declare additional weekly offs in the form of 1st & 3rd Saturdays in addition to the regular week off of 4 Sundays, can the establishment change its working hours uniformly to 45 hours a week, including the Saturdays where the establishment is required to work a full day? Or should it be by 45 hours a week and 48 hours a week according to the number of working days in a week? If so, would it be permissible under the said Act for an establishment to have two different working hours? Request expert advice on this matter.
