Dear Seniors,
Our company is in the field of Engineering Design & Head Office at Pune. Only for technical support, six months back they have opened this office at Chennai with the strength of seventy four employees. Salary, PF & ESI, etc, including electronic attendance will be handled from Pune itself.
Now pls explain whether it is mandatory to register our company in Tamil Nadu Labour Department. Kindly note all the labour related documents will be handled by HO.
Since they have registered with Maharashra Labour Dept., why we have to register here at Chennai & maintain all the records.

Since there is no regulation about the registration (like in other states such as Kerala,AP,Karnataka etc,) you please contact the LABOUR inspector of your area (for this you can ask the nearby big shops or offices) with FORM V (under national and festival holidays act)applicable to your office for the year 2009 (you may copy as per the Form V of your Pune Office). He will guide you to maintain registers and records under various acts under his jurisdiction and allot a number in the Form V such as R.DIS.NO......(which is to be mentioned in all your correspondences to the Labour Inspectorate and all future form V's)

Sir thanks for your immediate reply.
When I approach the Labour Inspector, definetely he will ask to register.
My question is whether it is mandatory or not?
If it is not, why I have to register?
Because our HO is telling that don't do it since our company is like a SW company & Chennai office is only supporting to HO.
Tell me SW & BPOs (having HO in different location) are getting their registration here or not?
Pls help me to come out with this issue.

Hi,
If your branch office is opened in your city where HO is situated other than same premises (this case consider you have opened one more office two buildings away from your HO, the registration is required and it is compulsary.
As I understand the registration is not mandatory under shops & establishment, however, you need to consider as a branch office and you need to submit the annual returns, holiday list approval from the Labour Inspector are mandatory.

I Think the registration is not required as per TN S & E Act, But u have to maintain the records such as Form P, Q, R, S, T for Labour Dept.
Requesting all to reply, If i am wrong.

dear
yes,you have to take licence from authority under tamilnadu shop and est act.so u have to register under the said act.you have to maintain attendance register there only ESI,PF and sother records can be maintain at pune however they can ask some records during inspection .you maintain in pune ,no legal hitch.

But I discussed with HO & there are telling that don't do it since our company is like SOFTWARE company & Chennai office is only supporting to HO.
In this regard,
1. Why we have to get the license? If not what will happen?
2. Could you explain SW & BPO's (having HO in different location) are getting their license here or not?
Pls help me to come out with this issue.
