Could you please help me regarding how the payment of gratuity will be processed in the event of an employee's death? For instance, if an employee has been with an organization for 3.6 years and unfortunately passes away, what formula should be used to calculate their gratuity?

Gratuity is payable only if an employee completes 5 year of service without breaks as it is a contribution only by the employer and can be claimed by employee only after 5 years

no Mr.Csriloo I Think If employee death & Parmnent Disablment less than 5 yrs service then he is eligble for gratutity. and gratutity caliclation is same B+DA*15/26*no of years. Regards, guru

Dear Guru,

Your question is not clear. I mean, does he still have 11 months of service left, or did he work for 11 months in an organization? Please clarify your point so we can understand your question better. In my opinion, a person who joins a company is eligible for gratuity from the first day itself.
