Hi All,

Due to some issues in our company, they failed to send the factory license renewal application to the "Inspector of Factories" for the year 2011. Please tell me what is the last day to send the application for the renewal. Is there any penalty we have to pay for the delay?

Dear Pradeep,

Normally, you renew the certificate one month before it expires. Yes, there will be a fine for not renewing on time. You will have to confirm the same from your local office. The fee/fine differs from state to state; hence, you will have to find that out yourself.

Please check with the Factory Inspector's office and confirm the license renewal fee details (normal), late penalty fee period-wise details, and act accordingly.

And then please post a thread to that effect with all the details on how you have done it and what the fee structure is for the information and knowledge of other members as well.

As such, the factory license is to be submitted for renewal in the month of October every year. If it is sent late, you have to pay a fine of 5% of the requisite fees (i.e., HP Load vis-a-vis the number of employees to be engaged, which is provided on the back side of the factory license renewal form) for every month until you deposit the application.

Dear Pradeep Kumar,

As per factory rules, every application for renewal shall be submitted, as nearly as possible, in Form No. 2, in duplicate, to the Chief Inspector on or before the 31st of December of the year prior to that to which the application relates. If the fees for renewal of the license are not deposited by the 31st of December, then the fees payable for renewal of the license shall be 25% in excess of the amount which would otherwise be payable if the payment of fees is made within three calendar months of the 31st of December. The fees payable for renewal shall be 50% in excess of the amount which would otherwise be payable for further default beyond three calendar months.

However, the Chief Inspector may waive the payment of excess fees if he is satisfied that there was a sufficient reason for the delay in payment.

Dear Baskar,

I have contacted the INSPECTOR OF FACTORIES on my end and received the following instructions. By October 31st of each year, we are required to submit the factory license renewal application. After this deadline, the fine increases each month by 10%, 20%, and 30%, respectively, based on the renewal fees.

The percentage will be calculated based on the renewal fees.

In the future, we can easily guide our people who are in need of these details. I am in the construction industry. In Hyderabad, I have paid 25% extra of the license renewal fee for the delay of 1 day in the submission of the application for the renewal of the Labour License.
