From earlier posts we have collected the following details for Tamil Nadu .Please confirm whether it is ok.
Tamil Nadu
1.Casual Leave – 12day in a year
2.Sick Leave - 12 day in a year
3.Earned Leave - 21days after completion of One year or 1 day for every20 working days
4.Maternity Leave: Women employee with minimum 3 month of service can avail 12 weeks, can be extended 6week in case of serious illness.

Andhra Pradesh
Leaves:
The Employee who has served for a period of 240 days or more is entitled for 15 days of leave with wages, 12 days casual leaves and 12 days sick leaves and such leave with wages may be accumulated up to a minimum of 60 days.
Every women employee shall also be entitled for paid leave for six weeks immediately proceeding the date of delivery and six weeks after the date of delivery.

Kerala State
1.Annual Leave for 12 days with wages after 12 months of completion of continuous service.
2.Leave with wages not exceeding 12 days on the ground of sickness or accident.
3.Casual leave with wages not exceeding 12 days .
4.Six days special casual leave for Sterilization operation in case of male employees and 14 days in case of female employees.

An employee is entitle to have one day Earned Leave for every 20 days of work performed by him & he is also entitled to have 12 Sick Leave during twelve months.

If worked less than one year -5 days for 60 days worked

CL/ SL not specified in Bombay Shops & Estb Act;-- under this Chap VII, Model Standing Orders are applicable

Leave can be carried forward up to 42 days & balance encashed at exit or retirement

Regulation Per The Industrial Employment (Model Standing Orders )Act 1946 Central Rules + Bombay Industrial Employment Rules ***
Regarding Casual Leave

a) Employees are entitled to CL but number of days is not specified

b) Can be taken up to 3 days at a time (Bombay Industrial standing Orders, Schedule 1. B. 16)

c) Can be prefixed suffixed with holidays but not with any other leave (Bombay Industrial standing Orders, Schedule 1. B. 16)

d) Leave with Wages are separate from CL & SL per Model Standing Orders (Bombay Industrial standing Orders, Schedule 1. B. 10. b)

MP Shops and Establishments Act provides for the following leave:
Earned : 30 days
Casual:14
Maximum accumulation of leave provided is 90 days.

Dear Mr. Rajan
5 days leave for every 60 days worked (if employment is for more than 3 months or
21 days, if worked for not less than 240 days in a year
can be accumulated up to 42 days
wages to be paid for unavailed leave, when the employee quits employment.
intervening weekly holiday will be counted (As Leave)
As per this calculation leaves 30 in a year for any employee worked complete in year.
Please clarify.

Hello Rajan,

Could you please shed some light on the following?

1. As per TN S&E Act, I understand 12 CL / 12 SL / 12 EL, whereas you mention 21 days EL. I agree with the point of 1 day for every 20 days worked.

2. Is it mandatory to encash the EL leave?

I would appreciate it if you could provide your comments/views on the above.

Could you please provide information on which leaves are applicable for this establishment? Also, is it necessary to pay sick leave for shops and establishments in Tamil Nadu that are covered?
