I need all your help in understanding the legal formalities to be completed regarding the notice that needs to be sent to an employee who has not reported for over a month. Through indirect sources, we have learned that he has joined another organization. Can I directly send a letter informing about the termination of his/her duties, or do I need to send some notice letters preceding the termination letter? The employee is still in the probationary period and has not been confirmed. Although practically, this letter might not mean anything to the person who has quit, I would like to close his file properly.

I need your advice.

Dear Radha,

My name is Raj. I understand your problem. Firstly, you need to send a telegram to his present and permanent address stating that you will be absent from duty from a specific date. If you receive any feedback, that's fine. If not, proceed with informing him that he is terminated from services effective from the mentioned date, as you had previously reminded him to attend duty as per the terms of the appointment letter (termination for misbehavior or prolonged absenteeism can occur at any time based on company policy).

Send the termination letter to the same address and close his account with the no dues form or clearance certificate from all relevant departments.
