Dear Upendra,

Bonus is a statutory liability to be met by the contractor. The Principal Employer is not legally liable for payment of bonus to the contract labour. The provisions of the Payment of Bonus Act, Section 8, 10/11 of the Act, impose an inescapable liability on the employer concerned to pay bonus to the employees concerned.

Even there are a number of judicial pronouncements from various High Courts & Apex Court that there is no difference between contractual employees and employees for the payment of bonus. Workers employed through contractors are also eligible to receive a bonus from their respective contractors.

No government notification is there regarding the chance of a bonus limit. We have had a discussion with GLO in Amreli district of Gujarat regarding the same. They have no official news on this matter. Kindly do not allow rumors to spread.

I have a doubt, please clarify this for me. Nowadays, hospitals have become profit-making entities and have shifted their focus from being service-oriented to being part of the hospital industry. Are hospitals covered under the Bonus Act? With the rise of many multispecialty hospitals, are employees in this industry no longer eligible for bonus payments as per the Act?

Dear Shyam Sunder Sir,

Thank you for sending the bonus notification. I would like to inquire if there is any law stipulating that the responsibility of paying the bonus to the contractor or contract employee lies with the principal employer.

Our principal employer has agreed in the agreement that they will pay the bonus at the time of Diwali with a separate bill. However, now he is stating that it is the contractor's responsibility, not the principal employer's.

There seems to be confusion regarding the applicability of the Act for IT/Software companies since the salaries are higher than the upper limit fixed by the Act. Can anyone clarify whether the act is NOT APPLICABLE, or if there are any provisions that IT companies need to comply with under the bonus act?
