Hi,

I recently joined a Medical Transcription company as an HR, and they also have a software development team. Currently, they do not have PF and ESI deductions in place. Could you please advise on the procedure to set these up? Are PF and ESI deductions mandatory?

As I am new to HR, I would appreciate your assistance in this matter.

Hi,

If your company has a staff strength of more than 20, then you can go ahead and register with the PF office and collect necessary forms, viz., Form 2, Form 5, 10, 9, 12, etc. The same is the case with ESI. If your employees' salary is more than 15k gross, then ESI is not required for them.

For PF, if the Basic plus DA exceeds 6500/-, then it is also not obligatory to pay PF.

Hi Masbee,

I am Pravin11, and I want to know about Form 9 (Revised).

1. Can it be filled up by the employer? It is mentioned that "for office use only."

2. When should Form 9 be submitted to the PF office? (for every new member joining)

3. Please send the soft copy because it is not available on EPFO.

Kindly send details ASAP.

If your company has more than 19 employees, you can proceed to register with the PF office and obtain necessary forms such as Form 2, Form 5, 10, 9, 12, etc. The same applies to ESI. If your employees' salary exceeds Rs. 15,000 gross, ESI is not required for them. Additionally, for PF, if the Basic salary exceeds Rs. 6,500, it is also not mandatory to pay PF.

PF and ESIC are both applicable if your company's employee strength exceeds 20. You have to register for PF and ESIC at the respective local offices. If you are based in Mumbai, please let me know, and I'll guide you through the process.

Dear Friends,

If the firm has more than a hundred employees and does not have ESI, and now if the firm is interested in going for ESI, do we have any alternatives? Can anyone provide insight on the same?

1. Dear member, the coverage under the ESI Act, 1948, and rules/regulations framed thereunder is statutory in nature and compulsory provided the factory is located in an area where the provisions of the ESI Act are extended under section 1(3) of the said Act and 10 or more persons are working. Further, in respect of certain establishments such as shops, etc., the power to extend the said Act is vested with the appropriate State Governments under section 1(5) of the said Act.

2. The coverage under the said Act is not optional and will be applicable in the unit/factory right from the day it employs 10 or more persons. Therefore, for further details and coverage of the unit to which you have referred, please contact the appropriate Social Security Officer of ESIC or the appropriate Regional/Sub-Office of the ESIC.
