Hi sir, my colleague, who worked as an assistant manager in WBD company, passed away suddenly due to a heart attack. He had a tenure of 13 months with the company. Is he eligible for gratuity?

  • If your company had taken any insurance cum gratuity policy, the legal representatives of the deceased employee may get gratuity worked out on the basis of his date of retirement. Otherwise, they will be eligible for 15 days pay of the deceased employee as gratuity. The amount shall be equal to salary (which shall be total salary excluding reimbursements and variable allowances) divided by 26 multiplied by 15.
