Dear Professionals,

Greetings of the day!

I need your expertise in the following case. Can a company track its employees through the company-provided mobiles to understand the whereabouts of the employees? Please suggest me on the below-mentioned points:

1. Is it legal for the company to do so?
2. Can an employee challenge it in a court of law?

Hi,

It is completely legal, which is usually the case with big pharmaceutical companies that purchase mobile tracking software or install GPS in SIM cards for all medical representatives. My first company was a small-sized pharma firm consisting of 50 employees who were planning to install GPS apps, but due to cost constraints, it made it difficult to implement.

Yes, this is called geofencing and geotracking, commonly used by FMCG and FMCD companies for their sales staff. It's an application or software downloaded on their smartphones, which helps them track their sales, has HRIS embedded, and also tracks their location.

There is nothing illegal about it.If the employee is required to visit certain places, this is the way to keep track. Is widely used in India by FMCG and Pharma Co’s Col.Rathi
