In Maharashtra, overtime of 117 hours a quarter is now allowed. Employees can raise a claim after leaving, but only up to a certain period - I think 3 months. However, I do not understand how he can claim cheating.

Cheating means, that employee did not know that, overtime payment should be in double the normal wages per hour as per the act, till that he thought that it is upto management’s policy,
