I have a doubt regarding leave calculation. I would like to know if an employee is on probation for 6 months, how should their leave entitlement be calculated - from the Date of Joining (DOJ) or the Date of confirmation of the employee?

Dear Snel,

In most companies, the leave entitlement depends upon the "Company Leave Policy".

In most cases, all leaves are entitled with effect from Date of Joining (DOJ). The employee can avail Casual Leave (CL) and Sick Leave (SL) as per company policy. However, Privilege Leave (PL) can be availed only after the Date of Confirmation. In the Factory Act, Shops & Establishment Act, and under many other State Acts, the entitlement of PL is governed by the legislating authority of the state. Therefore, you have to be very specific while calculating and allowing the "PL".

The number of leaves entitled will be calculated with effect from DOJ. Availing the leaves depends upon the company policy, which is formed keeping in view the number of employees, rotation, urgency of work, etc.

Theoretically, Probation is only for ascertaining the proficiency of the employee; it does not or need not have any nexus with the leave entitlement.
