I resigned from a company on 10th March 2014 after working for 10 years and 2 months. I submitted my resignation letter on 8th March 2014, which was accepted (2 days prior to resignation). My 2.5 months' salary, gratuity, and other dues are pending. I have already contacted the HR department three times via registered post regarding my full and final payment. However, the company is not showing much interest in resolving this matter. Please advise if I should consider taking legal action through the labor/civil court.

Give a legal notice for recovery of admissible dues if not already given. Make a complaint to the inspector under the Shops and Establishment Act. If you are covered as a workman under the ID Act, make a complaint to the labor commissioner for the recovery of dues. Regarding gratuity dues, file a separate complaint to the authorities under the Payment of Gratuity Act.

Have you received the acceptance of the resignation letter from employment? Sorry to say, but in case of misconduct, disobedience, and fraud, etc., the establishment can withhold your full and final settlement. If not...

Do as Mr. Sushil has suggested; that's the right way to claim your dues from the employer.
