Our company is a private limited company that was incorporated in October 2012. Previously, it operated as a sole proprietorship firm. We have holidays on all Sundays throughout the year and on major festivals such as Deepavali, Dassera, etc. Apart from these designated days off, if an employee takes additional leave, their salary is deducted based on a calculation (gross salary divided by the number of days in a month multiplied by the number of days of leave taken).
Is it possible for an employee to request a minimum of 12 casual leaves per year from the management? What are the regulations regarding leave policies for private limited companies?
In our company, only some senior staff members are granted one day of leave (out of 10 senior employees, with a total workforce of 55). I am also a senior employee, but I am not receiving this benefit. I believe that everyone should be treated equally. Please advise me on how to approach the management to address this issue.

Dear Friend,
If your company falls under the Factories Act, there is no provision to provide casual leave to the employees under this act. It allows only earned leave (based on last year's working days, with one day of leave granted every 20 days). However, the Shop and Establishment Act allows for casual leave and sick leave. Please review the provisions accordingly.
The allotment of casual leave is solely a management decision.

As far as leaves and holidays are concerned, there is no difference between private or public firms. For holidays, you can refer to the Karnataka Shops & Commercial Establishments Act, and for leaves, refer to the Karnataka Industrial Establishments National and Festival Holidays Act.

Leave Entitlement for Employees
Every employee of an organization is entitled to leaves, whether Casual Leave (CL) or Earned Leave. It is not at the management's discretion to decide whether to grant these leaves or not; it is compulsory for them to provide it. There need to be policies in place for leaves in organizations to ensure this.
