Dear All,

Please clarify one of my queries as follows:

1. I am working in the manufacturing industry. Last year, the Assistant Labour Officer approached us and asked to show the wages we are paying to the drivers. He mentioned that we should pay the driver wages under the Private Motor Vehicle Government Order. I disagreed with his statement and informed him that the Government Order does not apply to us as the Factory Act is applicable. As far as I am concerned, the Private Motor Transport Undertaking Government Order is not applicable if the employees are engaged under the Factories Act. Please clarify.

2. If we have fewer than 5 drivers in a manufacturing industry, do we need to register under the Motor Transport Workers Act?

Hi As per as my understanding if you are coming under factories act, i think you no need to register with other acts. Please clarify with your factory inspector. Regards Eswar.K 08056041800

Even I also believe that if you are falling under the Factories Act, then you don't need to procure any other license and not to follow any payment act except the Minimum Wages Act. I suggest seeking advice from a legal consultant in this matter.
