Hi All,
I have a query regarding whether a worker covered under the ESIC Act in Himachal Pradesh is eligible for sick leave as per the Holiday and Festival Act applicable in Himachal Pradesh. In this regard, can anyone share details of the section where it is mentioned that sick leave is not applicable if a worker is covered under the ESIC Act?
I need this information urgently. Please share as soon as possible.

If the basic Act (the state Shops and Commercial Establishments Act, which is an Act to regulate the conditions of service and to ensure welfare, health, and safety of workers employed) has provided for sick leave, you are supposed to give it to all employees, including ESI-covered employees. In respect of such employees, invariably, you are not paying wages for the days they remain on ESI leave.

Dear All,
I would like all of your advice on the below-mentioned query:
1. In case an employee is involved in an accident, what is the maximum time frame within which the accident must be reported to ESIC? According to the ESIC Act, accidents must be reported to the branch office within 24 hours. For instance, if an accident occurs on a Friday night and Saturday is a factory W/O, with Sunday being a government holiday, what should be done?
2. What types of accidents do we need to report? How can we distinguish which accidents should be reported or not? Are the same accident reports submitted to DISH under Form 24, even if the accident is a minor injury such as a skin cut or bodily strain, etc., in the common accident register for ESIC and MFR 1963?
3. Sometimes, the injury may be minor or not serious, but the worker is still required to fill out the ESIC form due to sick leave. How can we prevent or address such matters effectively?
I would appreciate your prompt response to this matter.
