Gratuity becomes payable if the employee who leaves, has completed five years of service.
The gratuity element is usually part of the Annual CTC - even if is not mentioned in your CTC, gratuity payment should be made.

My brother has worked in an IT company for only 2 years before he quit the job yet he has got it paid form the company.
Is the timeperiod of 5 years been changed?

There is no change in Gratuity Act.
If an employee has completed 05 years of his/her service he is legally entitled for Gratuity.
Some company fix the CTC in a way where Gratuity is a part of CTC in that case if employee leaves before 05 years he gets the amount as ex-gratia payment.

If the company is not having the policy to gratuity, then what is it mandatary to give gratuity after 5 yrs with the policy. Is this Act mandatary to all the Companies.

as far as my knowledge is of the Gratuity Act, every employee who has completed five years of continous service with any organistaion is eligible for claiming Gratuity. It is as good as a statutory payment and all companies are covered under the Act.

Bare Act mentions: Resigned employee completing 5 years of continous service has to apply for gratuity to the employeer. He can reicve the gratuity in his Full & Final Settlement or employeer should pay the gratuity on or before the completion of 30 days after the relieving date of the resigned employee.

I found this an interesting topic. I am helping a small company for the HR systems. The company has two identities and about 22 employees divided into these two identities.
Some employees have been in the organization since 10 years or so. There is not PF or Gratuity as a part of salary. Now is it possible that we add these components at least one of these components to the salary as a benefit.
If yes, how do we go about it ? Please help and also suggest a consultant who can help us for these details.
