Dear Lokesh,

ESIC returns are to be submitted two times, i.e., half-yearly return and annual return. For the period from April to September, the submission should be made within 42 days after completing the said time frame. Similarly, for the period from October to March, the submission should be done within 42 days after completing that time period. The form required for submission is Form-5 as per Regulation-26. The return should be filed at the nearest ESIC Local Office, and it is essential to attach the ESIC Challan copy with the return. Only one Form-5 needs to be deposited.

Dear Mr. Kamesh,

The employer shall be responsible for the correctness of all the particulars and information required for and furnished on the employer's registration form. It should be updated every year through FORM 01(A), i.e., annual report, before 31st January to Regional ESIC.

We are an ITES company with headquarters in Chennai and a branch in Madurai. We are covered under the ESI Act. An employee who was assigned to receive medical treatment at a Chennai hospital has been transferred from Chennai to Madurai. Currently, his family resides in Chennai while he is in Madurai. Could you please advise on the procedure to facilitate hospitalization claims for the employee in Madurai?

What Mr. VSP is suggesting is the correct procedure. These days, half-yearly returns are to be sent through the internet on the ESI site, i.e., eReturn or online preparation of returns. In Maharashtra, at Pune region, we have been sending eReturns for the last 2 years. This is a very fast and authentic method as we get printouts in quadruplicate and submit the same along with 6 copies of paid challans for the concerned contribution period.
