I would like to know what will be the penalty for not filing ESI half-yearly returns from April 2008 to April 2010, PF monthly returns from February 2006 to July 2010, and annual returns from April 2005 to April 2010.

Please let me know immediately as I want to provide feedback promptly.

I believe your employer will face a problem with inspection from the concerned department if there is not a valid reason for not filing the returns to the concerned department.

Are you deducting the amount from employees' part of wages? If yes, then it's a 100% penalty because you are utilizing employees' money and the interest on the PF amount. ESI doesn't matter if nobody has claimed it.

Go to the respected offices of each, catch the commissioner, take their advice, and sort out the issues. I hope you understand; otherwise, a 100% penalty means 100% of Rs. 100.00.

Dear Kavitha,

It's nothing to worry about. Just approach the authorities and submit the Reconciliation Statement and the returns. They will charge nominal penal damages and send a notice for not submitting the returns.

Dear Kavitha,

I advise you, please submit the returns as soon as possible because in both cases, the department can go to court against you for non-submission of the returns. In the case of ESI, please submit the return very soon. You will face a major problem at the time of inspection of EPF and ESIC.

Please prepare annual returns for all the years (Form 6, 3A), take a hard copy printout as well as a CD, and meet the commissioner. He will do the needful. Prepare a letter stating the reason for the delay.

I am sharing with you the knowledge and processes of the facility management industry in Mumbai.

Employers contract a labor consultant for their firm. Their charges are reasonable, typically between 1000 to 2000 per month. Against these charges, they provide the following services:

- Provide timely notifications of any changes in PF, ESI, PT, Minimum Wages
- Prepare monthly wages register and salary slips
- Prepare and submit PF & 12A, ESI, and PT Challans
- Yearly returns - PF (6A and 3A) in April
- Half-yearly returns - ESI (Form 6) in April and October
- Update minimum wages in the monthly wages register and salary slip
- Collect PF/ESI declarations from you and submit them to the respective offices (done weekly or monthly)
- Communicate with officials on your behalf
- Attend client meetings with your representatives (for any clarifications from the client side), etc.

You only need to appoint a consultant under an agreement, authorize them for communication and document submission, and pay their monthly charges.

Nothing happens if you have paid all the contributions and the ADMH charges. Just go ahead and file the returns now. Most probably, it will cost you a decent lunch and a small gift to the visiting inspector.
