Dear all,
I am confused about section 2(d)(i) of the BOC Act. Our company is engaged in the structural erection work of a power plant. The ALC of the respective state is compelling us to get registration under the act as per section 2(d)(i), but our work is not of civil nature. Despite this, we are not registered.
Please advise if the BOC Act is applicable to our company or not?

In my opinion, ALC seems to be right in implementing this law. We do not find any Section 2(d)(i) in the BOCW Act, 1996. Building or other construction work is defined in Section 2(d), and according to this definition, your work seems to be covered under work relating to construction, transmission, and distribution of power.

As per Section 2(d) of the BOCW Act, "Building or other construction work" means the construction, alteration, repairs, maintenance, or demolition of, or in relation to, buildings, streets, roads, railways, tramways, airfields, irrigation, drainage, embankment and navigation works, flood control works (including stormwater drainage works), generation, transmission, and distribution of power, waterworks (including channels for the distribution of water), oil and gas installations, electric lines, wireless, radio, television, telephone, telegraph, and overseas communication dams, canals, reservoirs, watercourses, tunnels, bridges, viaducts, aqueducts, pipelines, towers, cooling towers, transmission towers, and such other work as may be specified in this behalf by the appropriate Government, by notification but does not include any building or other construction work to which the provisions of the Factories Act, 1948 (63 of 1948), or the Mines Act, 1952 (35 of 1952), apply.
Request you to please confirm whether you are working in an operational plant or it is yet to be operational along with details of the scope of the job so that I can assist you better.
Please be informed that if your nature of jobs comes under the purview of the aforementioned definition, then you have to take registration under the BOCW Act and also have to provide welfare, safety facilities as stated under the act.
