I would like to inquire about the provisions laid down in the PF or ESIC Act for obtaining benefits in the event of death on duty for the deceased's family. Additionally, could you please provide information on the formalities that need to be completed by the employer or the family members of the deceased in such cases?

Dear,

In case of the death of the employee, the employer should inform the ESIC office. The employer has to submit a PM report, FIR copy, along with the accident report. After inspection by the inspector, he will submit his report to the Department, and the procedure will start for pension.

An employee passed away while in service, and he had not made any nomination on the PF portal. He recently got married. As per records, his family members were his father and mother when he joined. Please advise on how to settle and whom to pay the PF, gratuity, etc. Currently, his family members are his wife, father, and mother.

Recommended Actions for Claiming Benefits

The advisable course of action would be to get a joint claim by the members of the family along with a joint bank account and forward the related documents to PF & ESI authorities along with a copy of the death certificate issued by the authority concerned for releasing the benefit thereunder. The gratuity could be deposited with the Controlling Authority under the PGA 1972 (the local Labour Officer). As for unpaid salary, bonus, leave salary, etc., the amount may be deposited in the joint account.

Handling Disagreements on Joint Accounts

In case the bereaved family is not able to agree on a joint bank account, let the statutory authorities decide the ratio in which it is to be paid and follow the same ratio with regard to the non-statutory payments.
