According to the Factories Act 1948 and Karnataka Factory Rules, 1969, some activities, have notified by the State Government for the applicability of the Factories Act, 1948, where less than 10 workers employed. Please let me know these notified activities.

I do not know much about Karnataka Factory Rules but there are Model rules framed by DGFASLI, Mumbai which are then adopted with some changes here & there by State Legislative Assemblies to form State Rules. According to the Sec 87 of the Act, State Govt are empowered to declare any operation being carried out in Facotry as 'Dangerous', it may make rules applicable. Under Sec.85, State Govt are empowered to make the Act applicable to certain premises. So, normally, as general principle, State Govts lower the number of workers for applicability of the Act in case of Hazardous Operations. One may find the list of Haz.Operations declared by State Govt in the State rules under the chpater "Special Provisions". In Gujarat Chemical works, areas in factory with high oise, ( Higher than 90 dB), Welding/Cutting,Foundry,Glass industry,Ginding or glazing of metals, Places where Mercury, lead, Asbestos, Silica, Chromium ect are handled and workers are exposed to them etc.In Gujarat The Act is applicable to the units employing 5 or more inHaz. OPerations but in soem Haz. Operations, even if one worker is employed, Factory Act /Rules are applicable. Govt of Gujarat publishe dnotification in Nov.2008 and according to this notification, units where Asbestos is handled, Act will be applicable even if 1 worker is employed. Is there any standard law in Karnataka state of work which is statutory for employees to work for some fixed no of hours per day? If yes then please clarify how many hours:

In a week

In a month

In a year



For Example:



l Regular working hours are adjusted to allow for an earlier start to the weekend throughout the hot summer months

l Working hours are extended for the first 4 days in the week e.g. by 30 minutes – 1 hour.

l Last day of the week is reduced accordingly but by not more than half a day





Is there any standard law in your state of work which allows employees to work for reduced working hours at the time of some regional festivals? If yes then please clarify no of hours?



Is there any standard law in your state of work which allows employees to carry over their leaves for next year? if yes, please specify how many leaves

For Example:



l If an employee cannot take their annual vacation entitlement in full, they can carry over up to 5 days to the following calendar year

l Carry over days can be used until the end of the following calendar year

l Carry over days cannot be extended to the 2nd following year if it is not used

l The employee needs to update their manager about the days being carried over
