Hiring an adolescent involves several legal considerations, especially in terms of labor laws.
Firstly, the job application should be written in English or the local language and should include the adolescent's personal details, educational qualifications, and any relevant skills. He should also provide proof of age, such as a birth certificate or school leaving certificate.
Secondly, the letter of consent from the parents should clearly state that they permit their child to work for you. It should include the child's details, the parents' details, and the nature of the job. The parents should sign this letter.
Thirdly, according to the Indian Contract Act, a minor cannot enter into a contract. Therefore, you do not need a stamp paper to offer him a job. However, you should have a written agreement with the parents, which could be on your letterhead. This agreement should detail the terms and conditions of the job, including working hours, remuneration, and job responsibilities.
Fourthly, you need to inform the labor office about the employment of a minor. The information should include the minor's details, nature of the job, working hours, and remuneration.
Fifthly, you need to maintain a separate register for the adolescent, according to the Child Labour (Prohibition and Regulation) Act. This register should include the adolescent's details, working hours, and remuneration. It should be updated daily. A labor inspector can visit your establishment at any time to check the register and the working conditions for the adolescent.
Lastly, you are required to submit annual returns to the Labor Department, detailing the number of adolescents employed, their working hours, and remuneration.
Remember, employing an adolescent comes with responsibilities. Ensure you comply with all labor laws and provide a safe and conducive working environment for the adolescent.
