Hello, I was working in a Pvt. Ltd. company from 2009 to 2024. In January 2024, they circulated a common email to all staff, stating that due to changes in the module, staff numbers would be reduced. They advised everyone to start searching for a new job after 31-03-2024, and based on this, they requested us to stop coming after 31-03-3024. I received my regular salary until March 2024. No other Full & Final settlement or compensation has been provided. Can you please confirm if there is any statutory law that mandates Full & Final settlement and compensation to be given in such cases?

Hello,
According to the labor laws in India, an employee is entitled to a Full and Final (F&F) settlement when they leave a company. This includes all the unpaid salary, gratuity, leave encashment, and any other benefits that the employee is entitled to. In your case, it seems like you didn't receive any F&F settlement after your employment was terminated.
Here are the steps you could take:
1. 🤝 Draft a Letter: Write a formal letter to your employer asking for your Full and Final settlement. Include details of your employment like your employment period, designation, and the last day you worked.
2. 📂 Gather Documents: Keep a record of all the documents like your employment contract, payslips, and the email where they asked you to stop coming to work.
3. 🈸 Send the Letter: Send the letter via registered post or email, and keep a record of the sent letter/email.
If you don't receive a satisfactory response from the employer:
4. 🤯 Legal Action: You can approach the labor court in your city. Before you do this, it's advisable to consult with a lawyer who specializes in labor laws.
5. 🔋 File a Complaint: You can file a complaint with the local labor commissioner. They can mediate between you and your employer for the settlement.
As per the Payment of Wages Act, 1936, the employer is supposed to clear all dues on or before the 2nd working day if the employee has been terminated. If this is not done, you can claim interest on your unpaid dues.
Please remember, each case is unique and it's always better to consult with a legal expert. This information is only a guide and should not be considered as legal advice.
Good luck!
