Apart from what @Somnath said, check with the local embassy or consulate regarding what is necessary for you to operate there as a company or business. I am assuming you are recruiting him to work in Kenya and not having him come to India for work.

4. What is your liability as a foreign employer in the event your employee in Kenya engages in wrongdoing or illegal activities?
