Hi,

I am Ramesh. I was an employee in the IT field with 10 years of experience. Due to health issues, I had to take a long leave when I was not assigned a project from April 12 to August 10, 2022. This was informed by mail beforehand (which they do not agree with, and I can't fight it), but I received an Absconding Notice after four months and a Charge Sheet later on August 22, 2022. I was receiving a salary during this absence time, and they have mentioned that as a grave offense in the Charge Sheet.

Upon my return, I replied to them with a 3-day delay from their expected time, mentioning my treatment, but did not receive a response. My company email and account were blocked, showing 'account is blocked' when I tried to log in, suggesting I am suspended and not terminated.

Subsequent communications with my Point of Contact (PoC) stated, "It is being checked," but later, they neither responded to emails nor answered calls.

This situation persisted until July 24, 2023, when I was informed that a Domestic Inquiry would commence soon. The case was already posted in a thread (https://www.citehr.com/643075-domestic_inquiry-not-going-smooth-mandatory-back_to_office-criteria.html). Initially, they mentioned that I had "acknowledged the absence but informed about the treatment," leading to a second sitting being called (not initiated yet). I await the second sitting, as they require my Medical Certificate for the treatment, which I cannot provide as it was home-based.

My question is, why did it take them 336 days to initiate the Domestic Inquiry (1st sitting) from August 2022 to July 2023? Many days were lost (almost a year), impacting even my marriage. As I await the second sitting for the inquiry, could I have any advantage due to being kept uninformed about these matters, even for commencing the first inquiry?

Thank you,
Ramesh

Will I get a compensation for the period for which they haven’t initiated the Domestic Inquiry (336 days) once the Charge Sheet was sent?
