Good morning everyone, I request you to clear the following doubts regarding Gratuity
1. In the appointment order, no terms are mentioned to provide gratuity for employees working more than 5 years.
In that case, Are the company mandatory to provide gratuity? Please clarify.
2. In the employee file, which are documents to be maintained.
3. As we are providing increase in the salary slab, I required a draft of increment letter for the teachers, drivers and house keeping staff.

Hi,

1) Whether it is mentioned in the Appointment letter or not Gratuity payment is compulsory. Gratuity must be paid by companies which have hired ten or more employees. Employees must have completed 5 years of continued service within an organisation to be qualified for gratuity.

2) All employee related correspondences should go to employee file.

3) Increment letters are Company specific and there is no predefined format for increment letters. You may get lot of templates @ online which you may edit and use.

Gratuity is Mandated by Payment of Gratuity Act. It is applicable even if the same is not mentioned in Appointment letter, Policy etc.

Employee personnel file will have various documents & even the institute/organisation take call & following are the basic documents

Application form filled by the employee while joining
Employee data
Copy of the appointment letters/Increment letters/Promotion letters/Notices etc
Address & ID Proofs
Copies of Educational proofs
Nomination forms such as Gratuity, ESI, EPF, Payment of wages Etc
Others as applicable

As far as the gratuity is concerned the company has to pay for the employee after completion of 5 years period at the rate of 15 days salary per year on the gross and it has to be calculated for 26 days omitting Sundays.
The employee should contain all document pertaining to him/her like resume, educational certificates, previous experience certificates, training given and awards issued, including increment letter irrespective about the type of staff The HR procedure is the same .

1.Payment of gratuity is also a statutory payment, like PF, ESI. - which need not be mentioned in Appointment letters, in general. However, appointment letters are company specific formats (some companies may mention the same)
2. Starting with - copy of advertisement, copy of call letter, interview assessment form & recommendation for employment/approvals, Candidates'application form, Personal data form, copy of offer letter/appointment letters, duly acknowledged by him, joining report, copy of his induction program,
copies of testimonials of his academic, technical & professional qualifications and work experience,
photographs, copy of his medical fitness report, ID & address proof, contact details (address, mail ID, mobile number of person to be contacted, in case of any emergency), Nomination forms of Gratuity,etc
3.There are a lot of formats in Cite HR form for increment letters, you may select one which will be best suited to you.
