Hello All My Dear HRians,

I have a few questions that need answers, but I am receiving conflicting responses from various sources. Where is the best place to find accurate solutions, suggestions, and answers? I am posting my queries here, seeking your kind assistance.

1. Can ESIC membership be continued even after the age of 58 or 60, considering there is no specific retirement criteria in our organization on paper? If yes, what is the maximum age in this scenario?

2. Until what age can an insured person receive benefits from ESIC?

3. If an employee's salary is reduced with mutual understanding, and the acceptance of the employee is documented in writing, would there be any compliance issues with government regulations such as ESIC and PF, considering both the employee's and company's contributions will decrease?

Your insights and guidance on these matters would be greatly appreciated.

Hi,

For ESI coverage, there is no age limit. You can continue to deduct ESI as long as the employee's gross salary limit does not exceed ₹21,000 per month. You cannot reduce the basic salary of the employee in the middle of the contribution period.

(Fact Check Failed/Partial)-The user's reply is incorrect. ESIC coverage does have an age limit. Employees above the age of 58 or 60 cannot continue ESIC membership. The correct limit is until the age of 60. The statement about salary reduction affecting ESIC and PF contributions is accurate.
