Hi,

Our organization is facing an issue regarding PF and ESI contributions. One of our labor contractors has absconded, leaving the liability for January '23 and February '23 to the principal employer. The total employee strength under this contractor was 110 (Unskilled). We had already paid wages for those two months to all the workers, and for March '23, we have transferred this responsibility to another existing contractor for processing wages and statutory pay. For January '23 and February '23, we have already deducted the PF and ESI from the wages.

Please advise on how we can make the payment of ESI and PF for January '23 and February '23. Is it possible to do this through another existing contractor?

Payment of PF and ESI Contributions for Absconded Labor Contractor in Kolkata, India

In the situation where a labor contractor has absconded, leaving the liability of PF and ESI contributions for January '23 and February '23 to the principal employer, there are specific steps that can be taken to address this issue effectively:

👉 Legal Compliance Check:
- Ensure that all actions taken comply with the relevant labor laws in India, particularly the Employees' Provident Funds and Miscellaneous Provisions Act, 1952, and the Employees' State Insurance Act, 1948.

👉 Reconciliation of Deductions:
- Verify the total PF and ESI deductions made from the wages of the affected employees for January '23 and February '23 to accurately determine the outstanding contribution amounts.

👉 Direct Payment to Authorities:
- Contact the respective PF and ESI authorities to understand the process for making direct payments for the outstanding contributions of the absconded labor contractor.

👉 Engage with Existing Contractor:
- Discuss the possibility of utilizing another existing contractor to facilitate the payment process. While the primary responsibility lies with the principal employer, involving the new contractor can help streamline the payment procedure.

👉 Documentation and Record-Keeping:
- Maintain detailed records of all communications, payments made, and agreements with the new contractor to ensure transparency and compliance with legal requirements.

👉 Future Risk Mitigation:
- Implement robust monitoring and oversight mechanisms to prevent similar situations in the future, such as regular audits of labor contractors' compliance with statutory obligations.

By following these steps diligently and seeking guidance from the relevant authorities, the organization can effectively address the challenge of settling the PF and ESI contributions for the absconded labor contractor in Kolkata, India.
