In case of Contract workmen is it mandatory for the Contractor to issue an Appointment Letter to the Contract employee and is the Contract employee required to submit a letter of resignation in the event of quitting the Job? Is there any Legal requirement ? Would really appreciate the views of our esteemed and experienced professionals on this. Thanks.

Dear Kenneth Dias,

Every employer is required to issue a letter of appointment to an employee. That the employee will work somewhere else does not negate the value of the appointment letter. Secondly, the issue of appointment order is a statutory obligation.

Secondly, as a part of the proper separation, every employee is expected to submit a letter of resignation. The resignation letter helps the employer to arrange a proper replacement and helps in maintaining operational continuity. Again as stated earlier, just because the employee does not execute the work of the employer, does not negate the value of the process of separation.

The issue of appointment letters, resignation letters, and taking a proper clearance is part of the administrative procedure. Procedurally each organisation must be strong. It is in their interest.

If there is an appointment order and resignation letter it will give a prima facie documentary proof that the contract arrangement is genuine and is not a sham arrangement.
