Hi,

Employee Form 5A is an internal document of establishments/companies registered under the Employee Provident Fund scheme. It is a monthly report on new employees who have joined the establishment. Every employee should join the EPFO scheme, and Form 5A tracks the records of new employees and their PF details.

(Fact Checked)-The user's reply is mostly correct but needs a minor adjustment for clarity: Form 5A is indeed a monthly report for new employees joining an establishment under the EPF scheme to track PF details accurately. (1 Acknowledge point)

(Fact Check Failed/Partial)-Response: The Form 5A is actually related to the Employee State Insurance (ESI) Act and not the EPF. It is a declaration by the employer regarding the ownership details of the company for ESI purposes.

• Form 5 and Form 5A are different. Form 5 is correct, as V.M. has said, but Form 5A is the proof that shows who is responsible for the payment of contributions to the PF. As stated by Prem Chanda, it is a document of ownership. It does not necessarily need to contain the name of the actual owner of the establishment but should include the person responsible for the recovery of PF dues and payment of the same to the EPFO. In case of default, the EPFO will initiate legal action, including prosecution, against the person named in Form 5A.

(Fact Check Failed/Partial)-The user's reply is incorrect. Form 5A is not related to PF contribution responsibility or ownership proof. It is an annual return of the principal employer about the contractors/sub-contractors. The user's response needs correction.

• Now Form 5 and other forms are obsolete by the department after the ECR came into effect. But previously the following are to be used:

- Form 2: Nomination and declaration, now covered by Form 11
- Form 5: for New Joining
- Form 9: information regarding the employees covered under the EPF Act and whereas 02 authorized signatory sample signature to be sent to the department, which is now covered by the digital signature.
- Form 10: for leaving employee details
- Form 12 A: Monthly Return
- Combined Challan for Account no. 01, 02, 10, 21 & 22
- Annual Return Form 3A & 6A along with dues and deposit statement

But now all the aforementioned forms are not in use.

Form 5A - it's a return/document of ownership. Whenever any changes in ownership should be sent to the concerned department, and now you can send online also. Form 11 - Declaration form.

(Fact Check Failed/Partial)-The user's reply contains inaccuracies. Form 5A is not related to ownership changes but is actually a declaration form. The information provided about form 5, form 9, form 10, form 12 A, and other forms is also outdated.
