1) He met with an accident at the workplace due to sensor failure (the sensor was in the turned-off mode while working). Sensors are manually operated in on-off mode. He has completed a period of 7 days. This resulted in severe hand crush injury with amputation of the thumb, index finger, and major damage to the middle finger of the right hand.
2) He has to provide a statement to the Factories Inspector as instructed by the supervisors and HR. His statement is, "I joined today itself and was working at the machine along with the operator (another person). The operator turned off the machine to check a part and then turned it on to work again. At that time, I was placing the object (part), but the operator didn't see me while pressing the button." He was admitted to the hospital at that time and they assured him of all further needs. After the incident, the sensors were switched to automatic (always on).
3) ESIC was created on the same day the injury occurred.
4) He is a good student with post-graduation qualifications. For financial assistance, he wanted to join, and even asked if he was eligible. They employed him as a HELPER. Now, his life has been completely altered. Please help us inquire with the management about the expected compensation and any other benefits. Is it possible to pursue legal action, and if so, how?

If he is under ESIC, they will give him the compensation as per the law.

If the subject person was covered under Employees State Insurance, the due compensation will be paid to him provided the organization files the Accident Report online in the ESI Portal. The witness statement, treatment records, photos if any taken, a report from the supervisor in charge, and so on should be kept ready for inspection by the ESI Local Office Manager, along with the Attendance Register, Wage Register, etc. Upon satisfactory inspection at the organization, the ESIC will take up the matter for the settlement of due compensation as applicable to the nature of the injury to the person. Kindly approach the Management and the Local Office Manager of ESIC for necessary support.
