I joined Company A on 28 May 2021 and attempted to abscond by submitting my resignation on 22 June 2021. Subsequently, I joined Company B on 24 June 2021. Neither company was aware of my dual employment situation. Company A tried to contact me via email, to which I did not respond. However, on 30 June, they credited my salary and bonus, which startled me. I inquired with Company A regarding the payment, and they informed me that I needed to serve the notice period. This situation worried me due to the financial implications and the possession of the company laptop. Consequently, I fulfilled the notice period until 22 July 2021.

Currently, neither Company A nor Company B is aware of the situation, and I am feeling apprehensive and unsure about how to proceed. There is an overlap of 27 days in my UAN records, which is concerning. I am seeking advice on whether I should request Company A to adjust the dates or if I should disclose this to my current employer and explore the possibility of amending the joining date. Your suggestions would be greatly appreciated.

You have not mentioned the type of industry in which dual employment is legal in India. Even on your appointment letter, it is mentioned that you cannot work for a similar organization while you are employed with the current organization. If either organization becomes aware of this, they may initiate an inquiry and take action. The specific punishment for dual employment is not mentioned in the law, although the result may lead to termination. You may also face problems related to the provident department.

If you possess experience letters from both organizations, your future organization may also suspect you.

I agree with you. I don't have an experience letter from company A. I tried emailing them that I want to return the salary, but they are not replying. Should I inform my current company? I am thinking of telling them this week as this situation is causing me sleepless nights.
