Hi Guys, I was working with a company for 2.5 years. i got 1 apprisal when I was going to leave the company before 1.5 years ago. So Due to some communication between me and my boss. i decided and i resign(12-10-2021). But my salary was going to come after 2-4 days(16-10-2021). But I resign due to their misbehave of saying that i will have to beg them for sorry and many more. now they ask me for a notice period I start giving it is approx 5 days (Today). but I did not receive my last month's salary. so i ask with them that i need my salary please give it to me. if I hand over all the projects to you and your laptop etc. because I am on WFH. so they say (after five days) that we do not need your notice period. we want our software. that I was already going to give them.

But they say that they will test the code and software with another developer which they will hire. it is already 5 days after my resign that I found that I am not going to receive my salary and they do not want my resign and they also not giving me my document. I really become very frustrated. I do not have money. and when I say that I will go to labor court. then says go and take your money in court. and they are also saying that they will ask for money if any bugs are found in the software. guys, please let me what should I do and what is my legal rights.

You resigned from the company, without notice.
Then you are not willing to hand over the project and their laptop.

Now finally when they are holding your salary back, you are willing to give the code but not willing to let it be reviewed and verified.

Frankly, if I were your employer, I wouldnt pay you either.
Your ability to fight this in labour code is weak, specially if your salary is above the limits specified in the act.

Dear Bunty Goswami,

It is your gross mistake to resign so early prior to disbursement last month salary.

Why you resign is not a matter now, the issue is outstanding salary?

Either you or your advocate should write a letter to the management that you/ my client will not return laptop or Software or hardware or the task done by me/client unless you paid my last month's salary. Do not fall into their word and do not give anything. Better look for another job
