Dear Sachin,

As far as I know, there is no provision for carrying forward unavailed Sick Leave (S.L) from one year to the next; it automatically lapses at the end of the year.

On the contrary, Earned Leave (EL) can be carried over to the following years, subject to certain limits as stipulated in the establishment-specific labor laws applicable to your workplace.

Sick leave can be carried forward up to a certain limit. In some companies, management permits up to 30 days, while in others, it can be up to 40 days, depending on the leave policy in the HR manual of the company.

Casual leave cannot be carried forward; any unavailed portion of the casual leave shall automatically lapse at the end of the year.

PL/earned leave can be carried forward up to the limit prescribed under the leave policy of the company. It is observed that 60 days or 90 days of EL/PL accumulation is permitted.

Casual Leave cannot be carried forward - the unavailed portion of the Casual Leave shall automatically lapse at the end of the year. As far as PL/Earned leave is concerned, it can be carried forward up to the prescribed limit, i.e., up to 45 days; any leave above that should be lapsed.

Dear Member,

If your establishment is situated in the state of Haryana, then either of the Acts will be applicable to your establishment, i.e., the Factories Act, 1948, or the Punjab Shops & Commercial Establishments Act, 1958, as applicable to the state of Haryana. If your establishment is covered under S&E Act, then in accordance with the applicable Act, you can accumulate 30 days of EL while SL will lapse at the end of the year.

In the second case, if you are covered under the Factories Act, 1948, then you can accumulate 30 days of EL while SL will be granted under the applicable PIE (National & Festival Holidays & Casual & Sick Leaves) Act, 1965, and the same will lapse at the end of the year.

The EL can only be carried forward, but not SL. The balance SL lapses at the end of the calendar year if not availed. The balance EL can be carried forward at the end of the calendar year. You need to set a limit on EL accumulation in an employee's account according to what suits your establishment and in compliance with the state laws.

I think that the question raised by Sachin pertains only to the accumulation of the EL and S.L. statutorily applicable to his establishment. But Mr. R.K. Nair's reply refers to the practice adopted by some companies that cannot be disputed, regardless of the types of establishments run by the company. Such a provision is more beneficial. Unfortunately, the poster has not provided any clarification on this matter, despite my indication of the point, simply based on the place from where he raised the thread.

So far as I know, except for the West Bengal Shops and Establishments Act, 1963, which provides for Sick Leave on half pay for 14 days with a medical certificate under section 11(b) and permits its accumulation up to a maximum of 56 days, no other State S&E Act permits the accumulation of S.L. Even the Model S&E Act, 2016, passed by the Central Government, does not specify any sick leave.
