Dear sir, What happens to my maternity leave benefit if the company is going to shut or merge with another company? Plz advice.

In case of closure of the company nothing can happen. In case of merger you are eligible as pet the provisions of the act

If your company ceases to exist then the employer-employee relationship also ceases to exist. Sans this relationship, the claim for the maternity leave is not admissible. In case, during the course of the maternity leave if the company shuts down then the pregnant woman is eligible to get the paid maternity leave till the date of cessation of the company.
In case if the company merges with some other company then the new company is expected to accept all types of liabilities from the merged company. Under such circumstances, all types of claims by the employees remain valid and so is your claim for the maternity leave.
