Dear Sirs,

One of the contract workmen has been working for the last 7 years under the contractor. Due to his health problem, he has been unable to attend to duties for the past year and may not be able to attend for up to one more year.

He has asked me for advice. He wishes to withdraw his PF accumulation amount by submitting his resignation.

My queries are as follows:

1. If a workman continues for more than one year as NCP days, is he eligible for EDLI if the worker passes away?

2. Is his wife eligible for a widow's pension?

3. What is the procedure for claiming EDLI/Pension for workmen with chronic absenteeism or chronic medical issues?

4. What are the grounds for rejecting EDLI claims/Pension claims?

5. Is he eligible for gratuity?

Finally, what is the suitable advice to give to the contract workmen? Should we advise him to submit his resignation and withdraw the amount, or should we advise him to continue his PF membership as it is?

Edli entitlement is applicable to the employees covered under epf.Pls find the attached ammendmend notice in relation to edli.

If he is resigning he will get gratuity. He can withdraw EPF and EPS He or wife will not get pension EDLI is applicable only if the employee dies.
