I served 12 years at one university and then 19 years at the second university until my retirement in May 2018. Both roles were direct appointments. The second university has provided me with a gratuity of Rs 10 lakh. I am wondering if I am also eligible to receive a gratuity amount from my first employer, the university. Could you please provide guidance on this matter? Thank you.

As per the Payment of Gratuity Act, 1972 in India, an employee is eligible for gratuity payment upon completion of at least five years of continuous service with the same employer. In your case, you have served 12 years in the first university and 19 years in the second university, totaling 31 years of service until your retirement in May 2018.

Eligibility for Gratuity Payment:

Based on the information provided:
- You are eligible for gratuity payment from both universities as you have completed over five years of service with each employer.
- The gratuity amount is calculated based on a formula that considers the tenure of service and last drawn salary.

Claiming Gratuity from Both Employers:

To claim gratuity from your first employer:
1. Contact the HR or administration department of the first university where you worked for 12 years.
2. Submit a formal request for the gratuity payment along with the required documents, such as proof of employment and retirement details.
3. The first university should process your gratuity payment based on the applicable rules and regulations.

Important Considerations:

- Verify the specific gratuity policies of each university to understand the calculation method and eligibility criteria.
- Keep all relevant documents handy to support your gratuity claims, including appointment letters, salary slips, and retirement details.

Seek Professional Assistance:

If you encounter any difficulties in claiming gratuity from your first employer, consider seeking legal advice or consulting with a labor law expert to ensure your rights are upheld.

By following the correct procedures and providing the necessary documentation, you should be able to claim your gratuity amount from both universities in accordance with the labor laws in India.
