I joined a machine tool industry in Peenya, Bangalore in January 2019. A week back or so, the Managing Director (MD) called me into the room and started accusing and abusing me about my type of leadership. He used insults and threats. I was disappointed and scared by the abusive behavior to which I had been subjected multiple times while working for the company. Unable to endure it any longer, I resigned on the same day, informing them that I would serve the notice period of 3 months.

As things progressed, my manager called me and presented two options: either to be relieved on the same day or to work in another plant without being assigned any tasks. The issue is that I currently travel 20-25 km from home to Peenya, totaling 40-50 km in heavy traffic daily to reach the office. The new location they are proposing is an additional 45-50 km from Peenya, making it 65-70 km from my home, resulting in a total of 120-140 km of travel per day. Due to my family responsibilities, with 2 kids whom I need to take care of after office hours, traveling to that place is not feasible.

I was also threatened with the withholding of salary payment if I do not report to the new location. I requested to serve the notice period at Peenya; however, they are citing a clause in the appointment letter regarding transfers. I am willing to be relieved immediately if they pay me the 3 months' salary, as is a condition if either party chooses to avoid the notice period. They are not willing to honor this but insist on harassing me by transferring me to a different location.

Can a company transfer an employee after resignation with vindictive and harassing motivations to avoid paying the notice period money? Recently, they have accused me of deleting files from an additional laptop they provided and spreading negative rumors among other employees in the company. I suspect they are using intimidation tactics to force me to leave without receiving what is owed to me. There might be false accusations of theft, misconduct, and sexual harassment. Given the aggressive nature of my MD, I feel insecure about my health and safety working for him in a new place far away. I believe they are willing to go to any extent to damage my reputation, blackmail me, and threaten me into accepting to leave without receiving my salary.

Is there anything I can do to prevent being transferred and serve my notice period? What rights do I have, and what are my options to proceed against this organization?

Probably, you must have been employed in a managerial capacity. As such, all employment rights and obligations would be strictly as per the terms of the contract of employment. That's why the management is resorting to all sorts of foul play.

Therefore, it would be better to try to sort out the issue amicably. Be prepared to pay the notice salary and get yourself relieved forthwith or join in the transferred post and serve the entire notice period.

How come management transfer an employee, who has already resigned? You can lodge an FIR in name of your MD for all sorts of threatening.
