Hai, can any one help me with Minimum wages for Tamilnadu under Contract Labour Act for 2019-20?
From India, Chennai
Dear Ms.Susheela,
Minimum Wages under the Minimum Wages Act,1948 which is basically a monetary labor legislation are fixed, revised in periodical intervals and enforced by the appropriate Governments viz., the Central and State Governments only in respect of employments in any particular type of industry which are called scheduled employments i.e the employments finding place in the Schedule appended to the Act which is defined u/s 2(g) with the possibility of addition u/s 27 of the Act.
Whereas the Contract Labor (Regulation and abolition) Act,1970 is a restrictive as well as a prohibitive labor legislation pertaining to contract labor, a prominent form of indirect labor prevailing in all industries across the country. Thus the conditions of employment of the contract labor like wages, hours of work, leave , holidays etc., cannot be separate but the same applicable to the regular labor in the industry in which the contract labor are engaged along side.
Therefore, the minimum wages fixed for any employment equally applies to the contract labor employed therein.
Hence the minimum wages fixed in respect of your industry is applicable to the contract labor engaged therein is the answer.
