Dear Experts,

Please help me out. If a company has a manpower strength above 10 but no female workers are employed on the company premises, is the POSH Act applicable? Is the annual return under the Act required to be submitted?

Every workplace, including residences, is covered by all the provisions of the Act of 2013, namely the "Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act 2013," gazetted on 9.12.2013. There is no exemption whatsoever on the ground that not a single woman is employed at the concerned workplace establishment.

Hence, please take immediate action to get the Internal Committee constituted for your establishment in New Delhi or elsewhere where ten or more workers are employed/engaged.
