Dear Sir,

The employee's salary was less than 21,000 in the month of Apr-19 (ESIC contributed for the same). In the month of June-19, the salary increased to more than 21,000. In this case, how should ESIC contributions be handled? Should contributions continue up to Sep-19, or is there no need to contribute to ESIC from June-19 onwards?

Please suggest.

Hi, You are supposed to pay contribution till the end of contribution period i.e sep-19 and from october you can remove the IP from ESI contribution. Regards, KM

Dear Sir,

Kindly provide information if the employer deducts ESI contribution above the wage ceiling of 21000 from the beginning of the contribution period and submits it to ESI, and ESI accepts the contribution (no objection from ESI till the death of IP). Later, if the employee dies on duty due to an employment injury, and when the family goes to ESI, they refuse to provide benefits, citing the reason that the IP was drawing a salary higher than the ESI wage ceiling. ESI contributions are deducted from the employee's salary and submitted to ESI until death.

Now, what can the family do in this case?
