I had joined a company in November 2018. At that time, I was unaware of my pregnancy. My due date is in July. Post-February 2019, I got to know my company does not have any maternity policy, and now in April 2019, I am asked to resign as they cannot afford to either pay me for maternity or allow me to leave without pay. Please suggest.

Dear Friend,

1. Wherein 10 or more persons are working on any day of the preceding 12 months, then this act applies.
2. The employee should have worked for her employer for at least 80 days in the last 12 months.
3. An employee can avail of the benefit of 26 weeks.

If any employer fails to pay any amount of maternity benefit to a woman entitled under this Act or discharges or dismisses such a woman during or on account of her absence from work in accordance with the provisions of this Act, they shall be punishable with imprisonment, which may extend to 1 year, or with a fine that may extend to Rs. 5000, or with both.
